The latest is that Social Security lost some of my files and thus rejected my appeal. Now I have only a few days to request a hearing before an Administrative Law Judge. This is so riduclous. How can I owe the government more than they paid me? How can I owe the government more than I even earned when I went from job to job and no job to selling furniture and clothing etc to survive? This does not make sense. Anybody else fighting our US government in this manner?
The head person at the local social security office for 6 months claimed he had not received my file. On the very day I was able to finally confront him, I told him that he was the one who had signed the certified return receipt. He then asked if I had a fax machine and to fax him the file. I did that and the very next day I received a letter from HIM stating my waiver was denied. The hearing center had NEVER received my file for review. Later when I received a notice regarding a so called over payment off my ex spouse's social security number I went to appeal that and was told I had to first appeal the original overpayment. I said I had attorneys who had already done that. Well, he said I still had to appeal the first overpayment letter. I had with me, proof from social security that the funds had NOT even been paid to me but were sent to the overpayment center and applied to what they originally claimed I owed. Yet, going through the many many files of letters from Social Security, I found a decrepency where they had added instead of subtracted. Now I am told I have no claim, pay up or we stop your funds completely until the original amount has been paid in full. Get real...... The state attorney who had handled the original filing is no longer working in the legal aide dept. but remebered my case and emailed me what to do, file for a hearing before an Administrative Law Judge. This is not the first time I have been denied my hearing. The first time I showed up for the hearing but the person I was to meet with went home early without seeing me. That was in 1995. To date that hearing has never taken place. And this IS the USA!
